Please read these Terms and Conditions (“Terms”) carefully before using our website or booking any services. By accessing or using this website, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our services.

In these Terms, “we,” “us,” and “our” refer to pacific transportation company. “You” and “your” refer to you, the user of our website and services.

1 Scope of Our Services

pacifictourstrading.com acts as a travel resource and booking agent. Our services consist of providing information and facilitating bookings for travel-related services in China, including but not limited to tours, accommodation, and transportation (“Travel Services”).

Please be aware that we are not the direct provider of these Travel Services. We act as an intermediary between you and third-party suppliers such as airlines, hotels, local tour operators, and guides (“Suppliers”). Your booking is subject to the terms and conditions of these individual Suppliers, in addition to our own.

2 User Obligations & “Hard and Fast Rules”

As a user of our services, you agree to the following conditions:

Accurate Information

You are responsible for providing accurate and complete information for all bookings, including the correct legal names (as they appear on your passport), dates of birth, and passport details for all travelers in your party. We are not liable for any issues arising from incorrect information supplied by you.

Passport & Visas

You are solely responsible for ensuring that you and all members of your party are in possession of valid passports with at least six months’ validity from your date of entry into China. You are also responsible for obtaining all necessary visas, transit visas, and entry documents. Our “Visa Information” page is for guidance only; you must verify requirements with the official Chinese Embassy or Consulate.

Travel Insurance (Mandatory)

It is a non-negotiable condition of booking with us that all travelers must have a comprehensive travel insurance policy. This policy must cover, at a minimum:

  • Emergency medical expenses and repatriation
  • Trip cancellation and interruption
  • Loss or theft of baggage and personal belongings

We reserve the right to request proof of insurance at any time. Your travel insurance is your primary safeguard against financial loss due to unforeseen circumstances.

Health & Fitness

You are responsible for ensuring you are fit to travel and participate in your booked activities. Please consult your doctor regarding necessary vaccinations and health precautions for travel to China.

3 Bookings, Payments, and Discounts

Booking Process

A booking is made when you submit a pre-order or booking request and we receive the required payment. A booking is considered confirmed only when we issue a written confirmation voucher to you.

Pricing

All prices are quoted in New Zealand Dollars (NZD) unless otherwise stated. Prices are subject to change without notice until a booking is confirmed and paid for in full.

Online Order Discounts

From time to time, we may offer discounts for bookings made and paid for online (“Online Discounts”). These discounts are applied at the time of booking and cannot be applied retroactively. The specific terms of any discount will be stated at the time of the offer.

4 Payment Processing and Stripe Information

To ensure secure and efficient transactions, we use Stripe as our exclusive online payment processor for all pre-orders and bookings.

About Stripe

Stripe is a globally recognized, certified PCI Service Provider Level 1. This is the most stringent level of certification available in the payments industry. When you make a payment on our website, your card details are sent directly to Stripe’s secure servers and are never stored on our own systems. This ensures the highest level of security for your financial information.

Payment Process

When you proceed to payment, you will be interacting with Stripe’s secure payment gateway. Stripe accepts most major credit and debit cards, including Visa, Mastercard, and American Express. By making a payment, you agree to Stripe’s terms of service.

Stripe Remittances

Funds paid by you via Stripe are subject to Stripe’s standard processing and remittance schedules. This means that pacific transportation company typically receives the funds from Stripe several business days after your transaction is completed. Please be aware that the timing of any potential refund will be subject to this remittance process and Stripe’s own reversal timelines.

5 Cancellation and Refund Policy

We understand that travel plans can change. Our cancellation and refund policy is designed to be clear and fair, reflecting our role as a booking agent for overseas Suppliers.

Cancellation by You

If you wish to cancel your confirmed booking, you must notify us in writing. The following cancellation fees may apply, in addition to any non-refundable fees charged by third-party Suppliers:

Between 30 and 60 days before departure 50% of total booking cost
Less than 30 days before departure 100% of total booking cost (no refund)

Cancellation by Us

We reserve the right to cancel your booking in rare circumstances, such as due to a Supplier’s failure or a Force Majeure event (e.g., war, natural disaster, pandemic). In such cases, we will endeavour to offer an alternative arrangement or will pass on any refund we are able to recover from the Supplier, less any unrecoverable costs.

Our Refund Policy and Limitation of Liability

We are sympathetic to the fact that issues can arise during travel. However, it is critical for you to understand our role and the jurisdiction under which we operate.

Issues Occurring Outside of New Zealand: As a New Zealand-based booking agent, our services are legally rendered within New Zealand at the point of booking and payment processing. We are not the direct providers of the Travel Services in China. Therefore, we cannot be held liable and will not issue refunds from pacific transportation company for any issues, failures, disruptions, service quality complaints, or dissatisfaction arising from services rendered by third-party Suppliers outside of New Zealand.

This includes, but is not limited to:

  • Flight cancellations or delays
  • Hotel standards not meeting expectations
  • Changes to tour itineraries due to weather, traffic, or site closures
  • Dissatisfaction with local guides
  • Any personal injury or loss of property

Your Recourse for Overseas Issues

For all such incidents occurring outside of New Zealand, your primary and sole recourse is your mandatory comprehensive travel insurance policy. We strongly urge you to purchase a robust policy that covers all such eventualities. You may also have rights to pursue claims directly with the third-party Supplier (e.g., the airline or hotel) in China. We will provide reasonable assistance by supplying necessary booking documentation for your insurance claim.

Our Obligations Under New Zealand Law and Specific Refund Procedures

We are a New Zealand company and are fully committed to upholding our obligations under New Zealand’s Consumer Guarantees Act 1993 and Fair Trading Act 1986. These laws apply strictly to the booking services we provide to you from our base in New Zealand.

A refund may be considered only under the following specific circumstance: If our booking service itself is proven to be faulty or not fit for purpose (e.g., we book the wrong dates despite you providing the correct ones in writing, or we fail to pass your payment on to a Supplier), you have rights and remedies under these acts.

In such a proven case, any refund procedure will be handled in accordance with New Zealand law. The refund will be processed back to the original payment method via Stripe, subject to Stripe’s processing times, or via a direct bank transfer to a nominated New Zealand bank account.

6 Disclaimers and Limitation of Liability

Role as Agent

We act only as an agent for our Suppliers. We are not liable for any act, default, or failure on the part of the Suppliers or their employees.

Website Information

All information provided on this website (including our guides on visas, etiquette, and travel tips) is for general guidance only. This information is provided in good faith but can become outdated. You are responsible for verifying all information relevant to your trip.

Limitation of Liability

To the fullest extent permitted by New Zealand law, our liability to you for any loss or damage is limited to the total amount paid by you for the specific booking in question.

7 Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of pacific transportation company or its content suppliers and is protected by international copyright laws.

8 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts of New Zealand.
